Ervin ORDINANCE NO. 10126 AN ORDINANCE CLOSING AND ABANDONING PART OF HARBIN LANE LOCATED SOUTHEAST OF ALEXANDER DRIVE, SOUTHWEST OF HAYWOOD AVENUE, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned part of Harbin Lane located southeast of Alexander Drive, southwest of Haywood Avenue, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Part of Harbin Lane, a 60 foot wide unopened right-of-way beginning on the cul-de-sac at the south end of Harbin Lane, and extending southeast some 55 feet to the northwest line (if extended) of lot 79, Chattanooga Estates Company's Map of Lots 61A and 62A, a Partition of Lot 61 and the North Half of Lot 62, and Lots 78 and 79, Haywood Heights, as shown by plat of record in plat book 17, page 30, ROHC; said cul-de-sac being recorded in plat book 25, page 20, ROHC. Said part of street separates lot 6, Addition to Haywood Heights, as shown by plat of record in plat book 25, page 20, ROHC, from part of lots 56 and 57, Revised Map of Haywood Heights, as shown by plat of record in plat book 14, page 29, ROHC. Tax Map No. 118P-C-20, and 118P-D-4 and 5. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The Electric Power Board of Chattanooga has distribution facilities located within said right-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities and for ingress and egress to them. 2. The areas reserved for utility easements must be kept free and clear of all structures. 3. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
